Terms of Service

1. Agreement

By creating an account or using GoodAvatar.dev (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by the GoodAvatar.dev team; payments are handled by Waffo Pancake as our merchant of record.

2. Accounts

You need an account to generate videos. You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and be at least 16 years old, or the minimum age of digital consent in your country.

3. Credits and payments

• •The Service uses prepaid credits. Generating video consumes credits based on the duration of the generated clip (currently 1 credit per second).
• •Credits are personal to your account, are not transferable, and are valid for 180 days from the date they are added to your account.
• •Purchases are processed by Waffo Pancake, our merchant of record. Prices are shown before checkout and may change with notice; changes never affect credits you already own.
• •If a generation fails, the credits reserved for it are returned to your account automatically.

4. Acceptable use and content standards

You may only upload images and audio that you have the right to use. Portraits must be AI-generated: uploading a photograph or likeness of a real person is prohibited, whether or not that person has consented. The following categories of generated content are prohibited:

Enforcement: we screen prompts before generation, review reported content, and may remove output, suspend an account and forfeit its credits. Accounts that repeatedly violate these standards are terminated.

Reporting: write to support@goodavatar.dev with the task link and the task ID. We acknowledge reports within 2 business days, and we act on clear violations — removing the content and suspending the responsible account — within 5 business days. Reports involving minors or credible threats of harm are escalated immediately. We keep a record of reports and the actions taken, and we cooperate with lawful requests from competent authorities.

• •Sexual or NSFW content: no pornographic, nude, or sexually suggestive material, and no sexualized depiction of any person;
• •Child safety: no content that sexualizes, endangers, or exploits minors in any way;
• •Deepfakes and impersonation: no depiction of a real person, no synthetic likeness of any real individual — public figure or private person — and no use of output to deceive, defame, harass, or commit fraud;
• •Violence and gore: no content that depicts or encourages graphic violence, self-harm, or terrorism;
• •Hate and harassment: no hate speech, discriminatory abuse, or targeted harassment;
• •Intellectual property: no content that infringes copyright, trademark, publicity, or privacy rights;
• •Illegal activity and platform abuse: nothing unlawful, and no reverse engineering, scraping, reselling, or abusing the Service or its infrastructure.

5. AI-generated portraits only

GoodAvatar only accepts portraits produced by an image-generation model. You must not upload, or use, a photograph or likeness of a real person, including yourself, any public figure or any third party.

Every upload requires you to confirm that the portrait is AI-generated. We record that confirmation together with the account and the file, and we may refuse or remove content that appears to be a real photograph.

You are responsible for the rights in any material you upload. Accounts that upload real-person images, or that attempt to depict a real person, may be suspended and their credits forfeited.

6. Models we use

GoodAvatar is our own product; it is built on the following third-party models and providers, disclosed here as required:

Portrait images: Qwen-Image generation workflow via our third-party inference platform. Talking-avatar video: MiniMax H3 (full-reference video generation) via our third-party inference platform. Music: MiniMax Music3 via our third-party inference platform. Voiceover: MiniMax text-to-speech via our third-party inference platform. Prompt rewriting: a GPT-compatible model via our third-party inference platform.

These providers operate their own safety systems; we additionally screen every prompt ourselves before a model is called.

7. Your content

You keep ownership of the images and audio you upload. You own the videos you generate, subject to the rights of any third parties in the underlying material and to the terms of the AI models used to produce them. You may use the videos for personal or commercial purposes, including client work, ads, courses, and product pages. You grant us the limited license needed to store, process, and deliver your content solely to operate the Service. You are responsible for the content you generate and how you use it.

8. Service availability

We work to keep the Service available, but generation depends on third-party capacity and may be interrupted, throttled, or discontinued. Failed generations are automatically refunded in credits. We may suspend accounts that violate these Terms.

9. Disclaimers and liability

The Service is provided "as is" without warranties of any kind, except as required by law. To the maximum extent permitted by law, GoodAvatar.dev is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts for breach of these Terms or unlawful use. Unused credits of a terminated account are refunded where required by law or at our discretion when the termination was not caused by your breach.

11. Changes

We may update these Terms. Material changes will be announced on the Service or by email in advance. Continuing to use the Service after changes take effect means you accept the updated Terms.
