Terms of Service

1. Agreement

By creating an account or using GoodAvatar.dev (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by the GoodAvatar.dev team; payments are handled by Creem as our merchant of record.

2. Accounts

You need an account to generate videos. You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and be at least 16 years old, or the minimum age of digital consent in your country.

3. Credits and payments

• •The Service uses prepaid credits. Generating video consumes credits based on the duration of the generated clip (currently 2 credits per second).
• •Credits are personal to your account, are not transferable, and do not expire.
• •Purchases are processed by Creem, our merchant of record. Prices are shown before checkout and may change with notice; changes never affect credits you already own.
• •If a generation fails, the credits reserved for it are returned to your account automatically.

4. Acceptable use

You may only upload images and audio that you have the right to use. You must not use the Service to:

• •create videos of real people without their consent, or in a way that is deceptive, defamatory, harassing, or fraudulent (including impersonation and political or commercial misinformation);
• •depict minors in a sexualized manner, or any content that is illegal or promotes harm;
• •infringe copyright, trademark, publicity, or privacy rights of any third party;
• •generate content for hate speech, violence, or other unlawful purposes;
• •reverse engineer, scrape, resell, or abuse the Service or its infrastructure.

5. Your content

You keep ownership of the images and audio you upload. You own the videos you generate, subject to the rights of any third parties in the underlying material and to the terms of the AI models used to produce them. You grant us the limited license needed to store, process, and deliver your content solely to operate the Service. You are responsible for the content you generate and how you use it.

6. Service availability

We work to keep the Service available, but generation depends on third-party capacity and may be interrupted, throttled, or discontinued. Failed generations are automatically refunded in credits. We may suspend accounts that violate these Terms.

7. Disclaimers and liability

The Service is provided "as is" without warranties of any kind, except as required by law. To the maximum extent permitted by law, GoodAvatar.dev is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts for breach of these Terms or unlawful use. Unused credits of a terminated account are refunded where required by law or at our discretion when the termination was not caused by your breach.

9. Changes

We may update these Terms. Material changes will be announced on the Service or by email in advance. Continuing to use the Service after changes take effect means you accept the updated Terms.
